Notorial Services

Ensuring your documents have legal force and effect. We provide expert notarial services for affidavits, contracts, deeds, and wills with precision and care.

In the Philippine legal system, the act of notarization is far more than a simple rubber stamp on a document. It is a solemn and essential process that transforms a private agreement or statement into a public instrument, imbuing it with legal integrity, credibility, and evidentiary weight. A Notary Public is a duly commissioned lawyer who is vested with public trust and authority. Their role is to ensure the authenticity of a document by verifying the identity of the signatories, confirming that they have personally appeared, and attesting that they are executing the document as their own free and voluntary act.

At the Mamangun Law Office, we understand the critical importance of proper notarial acts. A notarized document provides security and peace of mind, as it is presumed to be valid and authentic in any court or government proceeding. We provide meticulous and reliable notarial services, ensuring that every document we handle strictly adheres to the Rules on Notarial Practice. Our commitment is to provide our clients with the assurance that their most important personal, business, and legal documents are executed with the highest degree of care and legal integrity.

Affidavits

An affidavit is a written statement of facts, voluntarily made by an individual under an oath or affirmation administered by a person legally authorized to do so—a Notary Public. Affidavits are fundamental in a vast range of legal and administrative proceedings. They can be used as evidence in court, to attest to the loss of a passport or other important document (Affidavit of Loss), to provide consent or support for a visa application (Affidavit of Support), or to declare a particular status or fact as required by a government agency. We assist clients not only in the formal notarization (the "jurat") but also in the clear and accurate drafting of affidavits to ensure they are effective and fit for their intended purpose.

Contracts

While a privately executed contract is generally valid and binding between the parties who signed it, notarization elevates its status significantly. Notarizing a contract, such as a Loan Agreement, a Lease Contract, or a Partnership Agreement, converts it from a private document into a public document. This provides an additional layer of security and enforceability, as it creates a legal presumption that the contract's execution was genuine and that the terms are binding not only on the parties but also on the public at large. Our notarial services ensure that the parties are properly identified and willingly consent to the terms, minimizing the risk of future disputes over the contract’s validity.

Deeds of Sale

The Deed of Absolute Sale is the primary legal instrument that transfers ownership of property from a seller to a buyer. For the sale of real estate, vehicles, and other valuable assets, notarization of the Deed of Sale is an absolute and mandatory requirement for the transfer to be officially registered with the proper government agency, such as the Registry of Deeds for land or the Land Transportation Office (LTO) for vehicles. The notarial act serves as the official verification that the sale was legitimate, protecting both the buyer, who secures a clean title, and the seller, who is protected from future claims.

Last Will and Testament (Notarial Will)

Planning for the distribution of your estate is a profound act of care for your loved ones. In the Philippines, one of the primary ways to do this is through a Notarial Will. Unlike a purely handwritten (holographic) will, a Notarial Will has strict and solemn legal formalities that must be followed perfectly for it to be valid. The law requires that the will be signed by the testator (the person making the will) and at least three credible witnesses in the presence of each other and in the presence of the Notary Public. The notary’s role is to oversee this formal execution and ensure every legal requirement is met, which is crucial for the will to be upheld during probate proceedings after the testator's passing.

Certifications and Other Notarial Acts

Our services extend to a wide range of other notarial acts required for various personal and business transactions. This includes:

  • Acknowledgements: The formal act where an individual declares before a notary that the signing of a document is their free and voluntary act.

  • Certified True Copies: Verifying that a copy of a private document is a true and faithful reproduction of the original.

  • Oaths and Affirmations: Administering oaths for individuals taking on official duties or making sworn declarations.

Each of these acts lends official weight and credibility to your documents, ensuring they are accepted and respected in your legal and business dealings.
